SECTION 13 also fixes the first audit under 394.9027(b) for a development acquired before the Act at the later of the 394.9027(e) date or 1 June 2026; applies the amended 394.905 to all HFC-owned developments regardless of when approved or acquired, subject to stated carve-outs; confines 394.905(b)(1)-(3) and (d) to developments acquired on or after the effective date; and required TDHCA to adopt rules implementing 394.9027(i) not later than 1 January 2026. WHETHER TDHCA DID SO WAS NOT ESTABLISHED THIS PASS. Cited for (d)(1), the five-year claim structure for allocations after 31 December 2016; (f)(3), determining a qualified low-income housing project under section 42(g) with no state overlay; (f)(4), the one genuine Hawaii modification -- recapture is made under section 42(j) "except that the tax for the taxable year shall be increased under section 42(j)(1) only with respect to credits that were used to reduce state income taxes"; (f)(5) and (g), importing the section 42(k) at-risk rules, the section 42(e) rehabilitation treatment and the section 42(f) and 42(i) definitions, which is what keeps the compliance period at the federal fifteen years despite the five-year claim. The practically important consequence is the gap: the state credit is fully earned in year five while the compliance period runs to year fifteen and the extended use period well beyond.

The Rural Housing Service's staff and lender handbook for the Section 538 guaranteed programme. Cited for what 7 CFR part 3565 does not say. Chapter 8 paragraph 8.12 B and C carry the programme's income method -- gross prior-year income of each adult member including interest from assets and all transfer payments, no adjustments or exclusions, and no entitlement to the deductions Section 515 allows -- and state that annual recertification of tenant income is not required, that a tax credit certification form may be used on a layered property, and that Form RD 3560-8 must be used where no other subsidy is attached. Paragraph 8.4 A states the layering rule: other programmes such as LIHTC may impose more restrictive income or tenant eligibility rules, the borrower must comply with all of them, and 'The Agency, in most cases, will defer to the most stringent requirements imposed as a result of alternative financing sources. However, this may not be appropriate in all cases' -- the Agency reserves the right to require Agency occupancy standards where the most stringent rules would starve occupancy and default the loan. Paragraph 8.12 E adds the utility allowance mechanics behind the 7 CFR 3565.203 rent caps. Cited for one thing the regulation does not say: 'The Sponsor must obtain prior approval by the Department before assigning a household that does not contain the specified minimum number of persons to a unit.' 25 CCR 8305(b) requires the special circumstances to be documented in the tenant file and makes the determination subject to Department approval but does not sequence the approval before the assignment. The memo also records that the occupancy standards reach non-HOME units at the same project that are assisted by other HCD programs subject to the Uniform Multifamily Regulations. Editorial correction 2026-09-13: agency_id now identifies the issuing Department of Housing and Community Development (ca.hcd), replacing the tax-credit agency placeholder (ca.hfa). It establishes the California delivery structure: the owner or property manager files with the State Recipient city or county that made the loan, not with HCD, so a portfolio owner reports to many bodies. Its enumerated verification checklist -- utility allowance entry accuracy, rent limit tied to the certification date on the same line, over-income rent by fixed/floating/Tax Credit status, the 24 CFR 92.252(b) twenty percent rule, minimum and maximum occupancy standards, and gross rent arithmetic -- is the most precise available statement of California's HOME monitoring scope.
