READ THIS BEFORE CITING PART 221 FOR A BMIR OCCUPANCY OBLIGATION. Part 221 as it stands today is almost entirely mortgage-insurance contract machinery, and the sections that once carried the BMIR project's OCCUPANCY terms are gone from the CFR: subpart C ('Eligibility Requirements - Moderate Income Projects') is now a single section, Sec. 221.501, which does nothing but cross-refer to 24 CFR part 200 subpart A, and surviving text still cross-references a Sec. 221.518(b) that the current part does not contain. The consequence is that the BMIR income limit, the BMIR rent and the 110-percent surcharge have no current CFR text at all and live in HUD Handbook 4350.3 REV-1 Chg-4 - which is why this corpus's BMIR occupancy rules are sourced to the handbook and the statute rather than to part 221. What part 221 DOES still carry that binds a BMIR property is Sec. 221.795, 'Displacement - below market interest rate mortgages', the URA relocation and displacement regime for BMIR owners, and Sec. 221.256, the mortgagee's at-least-biennial income and occupancy determination for BMIR SINGLE-FAMILY mortgagors under Sec. 221.60 and Sec. 221.65 - which is about a homeowner's mortgage interest rate, not a rental tenant's recertification, and must not be read as a tenant recertification cadence. eCFR re-renders current text.

THIS IS THE ONLY TENANT INCOME CERTIFICATION DHCD PUBLISHES and it is pre-HOTMA: Part IV prints an imputation trigger of 'If over $5,000' and a hard-coded 'Passbook Rate 2.00%', and carries 'the greater of the total of column I, or J' into total income from assets -- the greater-of-actual-and-imputed convention that HOTMA replaced. Part V's determination block offers only 60/50/40/30/__% and a 140% recertification line, predating the income-averaging election the QAP has offered since August 2018. DHCD publishes no HOTMA guidance and no updated certification form anywhere in the Multifamily Housing Development Document Library as of 2026-08-28. Rules citing this form encode the METHOD it imposes and emit the threshold and passbook-rate parameters with their `value` key ABSENT.

THE CITE THAT IS USUALLY WRONG: c. 62 § 6(q) is the Housing Development Incentive Program, a different credit for market-rate units in gateway cities. The state LIHTC is § 6I. Read in full 2026-08-29. What it establishes: the definition of "Regulatory agreement" requires operation in accordance with the section "for not less than 30 years from the expiration date of the compliance period", recorded as an affordable housing restriction under chapter 184 -- with a compliance period of 15 taxable years that is FORTY-FIVE years in total, the longest fixed state-credit affordability term found in this program; the compliance period is anchored to "the first taxable year the Massachusetts low-income housing tax credit is claimed", not to the federal credit period, so the two clocks can separate; (c)(3) claims the credit equally over 5 years, or in a single year for a qualified donation, with a 5-year carryforward; (d)(1) makes the eligibility statement a condition of allowance; (d)(2) keys recapture to federal recapture; (c)(5) and (f)(3) require a recapture statement naming each taxpayer; (f)(1)-(2) make the credit transferable on a statement to the Commissioner of Revenue; (g) has EOHLC monitor and report noncompliance "to appropriate state, federal and local authorities", which is wider than any federal reporting duty.
