This is the Trust Fund programme rule, NOT the Illinois Affordable Housing Tax Credit rule — that is Part 355, a different Part with a confusingly similar title. Part 360 is authorised by and made pursuant to the Illinois Affordable Housing Act [310 ILCS 65] and implements sections 4 and 7(e) of it. It has not been amended since 2001 while the Act has been amended repeatedly, most recently by P.A. 103-616 eff. 7-1-24; where the two diverge the Act governs.

This is a Paperwork Reduction Act notice: it DESCRIBES the Section 236 excess income collection rather than imposing the obligation, which is why its authority_weight is persuasive rather than regulation. It is cited here because it is the only dated, verbatim, publicly retrievable statement found this session of two operational facts a Section 236 compliance specialist is held to -- that the report is monthly ('Frequency of Response: 12') and that a request to retain excess income 'must be submitted at least 90 days before the beginning of each fiscal year, or 90 days before any other time during a fiscal year that the owner plans to begin retaining excess income for that fiscal year'. The underlying obligation is statutory at 12 U.S.C. 1715z-1(g); the binding instrument stating the program requirement is HUD Handbook 4350.1 and/or a HUD Notice, NEITHER of which was retrievable for this pass. Earlier notices in the same collection run back to at least 2010 (FR documents 2010-13113, 2013-07068, 2013-15997, 2016-19506, 2016-27909), so 2020-08-13 is the date of the document READ, not the date the 90-day requirement arose. Do not treat it as the latter. The collection reports 835 respondents, all Section 236 project owners, filing via Pay.gov.

CURRENCY ESTABLISHED AS FOLLOWS, because ADFA serves several editions from the same site. (1) ADFA's own tax-credit document library (https://adfa.arkansas.gov/document_category/tax-credit/) lists exactly one current manual, titled 'Affordable Housing Compliance Manual - 2026', and links this 3-31-2026 file. (2) A general web search instead surfaces first a sibling file, '...Preliminary-Version-1-26-2026.pdf' (166 pages, 12,863,452 bytes, sha256 f493fe85cb30d976aaf9c7cc133bee5865d46f2fd9c708cdcd5e92139ef0f039, ModDate 2026-01-26). Both files were downloaded and their extracted text diffed: they are identical apart from two PDF line-break artifacts, so the 1-26 and 3-31 printings are the same content and no rule turns on the choice; the 3-31 file is cited because it is the one ADFA's document library links and it carries the later ModDate. (3) A third, materially DIFFERENT and superseded manual is still served from the same ADFA document-library page - the '2014 - 2015 Compliance Monitoring Policies and Procedures Manual' (see src.ar.compliance_manual_2014_superseded) - and it is also what Novogradac and the Arkansas Secretary of State rules register mirror. It states a 60-day correction period, an 8% Tier-1 monitoring fee and UPCS as the inspection standard, against this edition's 30 days, 10% and NSPIRE. Nothing was encoded from it. STRUCTURE: a combined manual. Pages 1-136 of the PDF are the LIHTC Compliance Manual (Chapters 1-12, printed pages 1-130); page 137 onward is a separate HOME Investment Partnership Program / HTF compliance manual with its own chapter numbering and printed page sequence. Only the LIHTC half was read and encoded this pass. Citations use the manual's own printed page numbers ('Compliance Manual Page N' in the footer); PDF page = printed page + 6 in the LIHTC half. NOTE ON STATUS: every printing ADFA has posted since June 2025 carries 'Preliminary Version' in its filename, and the manual was announced (2025-06-24) as a draft revised for HOTMA; ADFA nonetheless publishes it in the document library as the 2026 manual with no other current edition. The operative form behind the February 1 annual certification. Cited here for four items that are ADFA-specific and corroborate the manual: item 4 (an annual Student Self-Certification for EVERY low-income household, with no 100%-project carve-out); item 5 with its instructions to upload the rent schedules and the utility allowance schedules for the certification year; item 21 (the owner certifies ADFA tenant-data reporting was maintained 'with any changes being updated by the 15th of the month following the change'); and items 15 and 18 (no change in ownership or management since the last certification; continued compliance with everything the owner agreed to in its application, which is what makes the QAP-scored commitments enforceable in the compliance layer). NOTE A CONFLICT WITHIN ADFA'S OWN MATERIALS: item 8 of this 01/2025 form still certifies suitability for occupancy against 'Uniform Physical Condition Standards (UPCS) as defined by HUD', while the 2026 compliance manual (Chapter 10 Section G, printed page 123) states ADFA uses NSPIRE, which replaced UPCS in 2023.
