Old but current. Two consequences. First, it predates NSPIRE and still elects UPCS (ch. 5, Annual Reviews and Physical Inspections), while the Owner's Certificate NIFA published for reporting year 2025 certifies to NSPIRE - the conflict is encoded on ne.lihtc.physical_inspection_three_year_cycle_notice rather than resolved. Second, it says nothing about HOTMA. NIFA's 2026/2027/2028 Allocation Plan sec. 18 makes it operative: 'Additional guidance can be found in the NIFA Compliance Manual located at www.nifa.org.' Note that NIFA also keeps the superseded 2022-2023 and 2024-2025 Allocation Plans live on the same page, so edition-picking on this site cannot be done by search rank.

HUD's Title VI regulation. 24 CFR 1.4(a) and 1.4(b)(2)(i) are the surviving regulatory basis for national-origin nondiscrimination in HUD-assisted housing after E.O. 13166 was revoked (E.O. 14224, 1 Mar 2025) and HUD withdrew both its 2007 LEP Final Guidance (effective 17 Sept 2025, 91 FR 17291) and its 2016 OGC LEP guidance (effective 25 Sept 2025, 91 FR 44867). Part 1 itself was not amended by either withdrawal.

Withdraws eight FHEO guidance documents effective 17 September 2025: the 2024 digital-advertising guidance; FHEO 2020-01 (assistance animals, 28 Jan 2020); the 2024 source-of-income testing memorandum; FHEO Notice 2013-01 (service and assistance animals, 25 Apr 2013); the 2021 special purpose credit programs statement; the 2007 LEP Final Guidance (22 Jan 2007); the 2021 implementation of E.O. 13988; and the 2022 implementation of the OGC criminal records guidance. The notice states the documents 'have been removed from active use and should not be relied upon as authoritative' and that they have been removed from HUD.gov. It also preserves the underlying statute: 'Any actions that do not comply with the text of the Fair Housing Act continue to be subject to enforcement by the Department', and complainants retain the two-year private right of action. FHEO 'is continuing to review its need for existing guidance' and says guidance found necessary 'will be reissued'. Note the publication date is nearly seven months AFTER the effective date of the withdrawal, so any rule authored between September 2025 and April 2026 against these documents was already stale when written.
