Development Bank of American Samoa, Student Status Affidavit (LIHTC or Tax Exempt Bond Compliance Period), Spectrum Enterprises 2013
Publisher: Development Bank of American Samoa (DBAS), forms prepared by Spectrum Enterprises, Inc. as delegated monitor
American Samoa · Published 2013-01-01 · Last fetched 2026-09-06 · 1 linked current rules
1 page, 18,223 bytes, sha256 fde85adba6d52f21e6345d8bfa4d3ed711036e014675b977a9651e1feda6f755, fetched 2026-08-29. Dated 2013 from the form's own printed footer, not from the 2023 posting path. Marked either 'Move-in' or 'Annual recertification' with the applicable effective date, which is what establishes that the portfolio requires a student certification at both points. Asks 'Will all of the persons in your household be or have been full-time students during five calendar months of the certification year?' and, if yes, the five exceptions: AFDC/TANF; previously in foster care under Part B or Part E of title IV of the Social Security Act; enrolled in a Job Training Partnership Act programme (federal, state or local); a single parent living with minor children where the parent is not a dependent as defined in Section 152 and the children are not dependants of another individual other than a parent; married and filing a joint return. Carries the tenant undertaking 'I agree to notify management immediately if my student status changes' and is signed under penalty of perjury by tenant, every co-tenant and the manager. The title's '(LIHTC or Tax Exempt Bond Compliance Period)' is Spectrum's multi-programme heading and is NOT evidence that American Samoa has bond projects; it does mark the form as a compliance-period instrument, and no extended-use student form is published for the portfolio. Cited by as.lihtc.student_status_affidavit_and_institution_verification.
Development Bank of American Samoa, Student Verification, posted to dbas.as under Required Tenant Documents
Publisher: Development Bank of American Samoa (DBAS), forms prepared by Spectrum Enterprises, Inc. as delegated monitor

The portfolio's third-party student verification: 'THIS SECTION TO BE COMPLETED BY MANAGEMENT AND EXECUTED BY STUDENT'. The student grants disclosure of the requested information from a named educational institution, signs, prints their name and student ID, and the form is returned by the institution rather than by the tenant. Establishes that the American Samoa portfolio runs institution-side verification of student status rather than relying on self-certification alone. Development Bank of American Samoa, Under $5,000 Asset Certification, Spectrum Enterprises 2013
Publisher: Development Bank of American Samoa (DBAS), forms prepared by Spectrum Enterprises, Inc. as delegated monitor

One form per household including children's assets, for households whose combined net assets are under $5,000. Enumerates cash on hand, prepaid debit card balance, average six-month checking balance, current savings balance, 401k/IRA/CD/money market, stocks/bonds/retirement, life insurance other than term, safe deposit box, equity in real estate, lump sum receipts (lottery, inheritance, insurance, lawsuit) and other, each with its interest, dividend or rental income. Four valuation instructions: cash value is market value minus conversion costs (broker fees, settlement costs, outstanding loans, early withdrawal penalties); list only amounts accessible to household members, so not a retirement balance requiring termination of employment to access; exclude necessary personal property; include personal property held as an investment such as artwork, antique cars, coin collections and gems. Item 5 asks whether any asset was sold or given away below fair market value IN THE PAST 2 YEARS, with asset, disposal date, fair market value and amount received. THE $5,000 THRESHOLD AND THE TWO-YEAR LOOKBACK ARE PRE-HOTMA and no DBAS or Spectrum document mentions HOTMA. No over-threshold form is published, so what a household with assets above $5,000 files is not established, and no passbook rate is published anywhere in the portfolio's materials. Linked from dhcd.dc.gov/assetmanagement. Returned to PAMD.Compliance@dc.gov. Requires the effective date of the last utility allowance schedule and the effective date of the last rent increase alongside the ownership/management change detail, a fully executed copy of the new management agreement as Exhibit A, disclosure of any affiliation between the new management company and the borrower, and dual owner/manager signatures. The form recites that DHCD 'does not endorse or provide blanket approvals of any property management company for any purpose.' The 2025 QAP separately names a 'Notification of Project Changes Form' at dhcd.dc.gov/assetmanagement; this is the form published at that address, but the naming mismatch is recorded as an open question rather than assumed away.

That page's "Required Forms" table is how the current edition was established. `published` null; no date of any kind on the face. READ THIS PASS AND CITED ONLY AS A GAP: the manual (ch. IX sec. D.7) requires a zero-income applicant to execute a Zero Income Affidavit AND provide a signed copy of the prior year's federal return, or IRS Form 4506(T) where none was filed. This form asks neither; it asks yes/no to seventeen income sources and for a written explanation of how the household will pay for rent, utilities, food, clothing, school supplies, telephone, medical care, prescriptions, personal care products and transport. The divergence is recorded as an open question on de.lihtc.income_calculation.highest_hours_and_higher_of_two_annualisations.

City of Austin Housing Department, Density Bonus 90 (DB90) Applicant Guide, effective August 1, 2026, 12 pp.

DB90 IS CLOSING TO NEW ENTRANTS AND THE GUIDE SAYS SO TWICE: 'Beginning June 1, 2026, no new zoning applications are allowed to be submitted to Austin Planning for -DB90 combining district zoning. Sites with existing -DB90 combing district zoning may apply to and participate in the DB90 density bonus program. (See Ordinance No. 20260521-056.)' The replacement is the Citywide Density Bonus Program 30 (-DBC30), which was NOT read this pass and is not represented in this corpus. Affordability: rental 12% of units at or below 60% MFI or 10% at or below 50% MFI, affordable 40 years from date of certificate of occupancy; ownership 12% at or below 80% MFI for 99 years, or a fee-in-lieu equivalent to 100% of the required on-site units at a per-unit rate set by annual fee schedule. The guide restates Chapter 4-18's unit standards -- comparable bedroom mix with efficiency as a distinct type, functional equivalence, dispersal, equal amenity and parking access -- as amended through Ordinance No. 20260521-036.

SIX NAMED DEVELOPMENT AGREEMENTS, EACH WITH ITS OWN BAND AND ITS OWN NUMBERS: Mueller at 60%, Robertson Hill at 80%, Domain at 65%, AMLI on 2nd at 80%, Southshore and Estancia at 60%, Northshore (GWTP) at 80%. Unlike the density bonus sheet this table separates efficiency from one-bedroom, and the separation is not consistent -- Mueller prices an efficiency at $1,411 and a one-bedroom at $1,512 while Southshore and Estancia price both at $1,317, and Northshore prices an efficiency ABOVE its one-bedroom ($1,869 against $1,411). Robertson Hill and Northshore stop at three bedrooms. The compliance guide adds that rates 'may vary from rates published here in accordance with other requirements specified by a specific development's Development Agreement', so even this table is not final for a given property.

Both dates are off the document's own cover, which prints 'Effective Date: October 1, 2015' and 'Revised: June 1, 2026'; every page footer repeats 'Rev. Eff. 6/1/2026'. THIS IS THE CENTRAL COMPLIANCE INSTRUMENT FOR TEN AUSTIN PROGRAMMES, which it names on page 1: S.M.A.R.T. Housing, Vertical Mixed Use (VMU) Density Bonus, Transit Oriented Development (TOD) Density Bonus, Downtown Density Bonus (DDB), Rainey District Density Bonus, North Burnet Gateway (NBG) Density Bonus, East Riverside Corridor (ERC) Density Bonus, Affordability Unlocked, Density Bonus 90 (DB90), Density Bonus Equitable Transit Oriented Development (DBETOD) and negotiated Development Agreements. University Neighborhood Overlay projects are expressly carved out to a separate guide. Sections used: Pre-Development Requirements (Affordability Certification Letter, administrative hold on building permits, the six minimum contents of the recorded Restrictive Covenant, p. 2); Compliance items 1-4 (set-aside maintenance, the three required lease provisions and the 12-month minimum term, non-optional fees inside the cap with eight utility services excepted, tenant file contents and 4-year on-site retention, pp. 3-4); item 5 (no proof of citizenship or immigration status, alternatives to traditional credit, p. 4); item 6 (household definition including minors, all occupants eligible, the six-month determination currency rule, the rejection letter, the 2026 income table, pp. 4-7); item 7 (annualisation equations, p. 7); item 8 and the Maximum Rent Limits Tables (the two density bonus tiers and the six Development Agreements, pp. 7-9); item 10 (supportive housing MOU, 30-day provider hold, 2-business-day notice, next-available-unit, pp. 9-10); Monitoring items 1-5 (initial review within 12 months of certificate of occupancy, 14-day notice, 30-day follow-up letter, the finding/deficiency/concern grades, the 30-day correction period, pp. 10-11); General Requirements items 11-15 (fair housing, amenity parity, verification forms, renewals, the 120% MFI over-income rule and the 28%/30% renewal rent cap, the affordability period counted in compliant years, pp. 11-12).

THE DATE IS OFF THE DOCUMENT, NOT THE FILENAME: the page prints '(Effective June 1, 2026)' while the file is named Development_Incentives_Rent_Rates_7.31.2026.pdf. Two tiers on one page. S.M.A.R.T. Housing and Vertical Mixed Use: 50/60/80 percent bands. DB90, ETOD, TOD, Downtown Density Bonus, Rainey St, North Burnet Gateway, East Riverside Corridor, Affordability Unlocked, Whisper Valley PUD and Pilot Knob PUD: 30/50/60/70/80 percent bands. BOTH TIERS COLLAPSE EFFICIENCY AND ONE BEDROOM INTO A SINGLE COLUMN and run only to five bedrooms. Checked cell by cell against the 2026 income chart in src.tx.austin.housing_hud_income_limits_and_rent_rates_2026: the density bonus tier is 30% of the band's income limit at household size equal to the bedroom count (efficiency and one-bedroom both at one person), and the S.M.A.R.T./VMU tier is the same at 28% -- which matches the compliance guide's own over-income renewal language. Two footnotes matter: 'Properties which participate in a state or federal affordable housing program, such as the Low-Income Housing Tax Credit, may utilize the rent limits established by that state or federal program', and 'Staff anticipate 2027 rent rates will follow HUD limits and will include separate rent rates for efficiency and one bedroom units. Staff will also consider establishing utility allowances.'

Posted by DHCD as 'DHCD Compliance Manual - Low Income Housing Tax Credits' (publication page dated 2012-03-02), reachable from dhcd.dc.gov/service/project-monitoring. Despite the 2012 date this is the operative monitoring document: the DHCD 2025 QAP (p. 6) states that both 9% and 4% credits 'must comply with two DHCD monitoring procedure guideline documents: the "DHCD Low-Income Housing Tax Credit and HOME Investment Partnerships Program Owner's Compliance Manual" and the most recent "RFP Compliance and Monitoring Reference Guide," which is incorporated by reference in this QAP.' Filename says 'Feb2011' and interior footers say 'Effective February 2011' while the cover page and DHCD's own catalogue entry say February 2012; the cover date is used here. Known stale content within it: the $35/unit monitoring fee (superseded by the 2025 QAP fee table) and UPCS as the inspection standard (DHCD's Portfolio and Asset Management page now states NSPIRE is followed). Part II (HOME) and Part III (Forms) are separate files and were not fetched this pass.

The 2025 QAP (p. 36) refers to 'PAMD's Utility Allowance Guidelines, available here: https://dhcd.dc.gov/service/project-monitoring'; that page does not currently link a utility allowance document, and this January 2021 policy is the most recent published DHCD utility allowance procedure located. Whether a newer edition exists behind the QAP's reference is recorded as an open question on the utility allowance rule rather than assumed. The document contains an internal inconsistency, disclosed rather than smoothed over: the General Information section says options 1 through 3 'would not normally need to send DHCD a request for approval,' while the option 2 and option 3 sections each require a $150 check and a full submission package.

Also the canonical home of the Ownership/Management Agent Change Form, the LIHTC and HOME lease addenda, and the April 2026 HOTMA memo. CONCURRENCY NOTE for integration: a parallel voucher-program authoring pass registered this same id in data/sources/pending_voucher.json, then removed it while this pass had briefly renamed its own copy, leaving three of that pass's rule files (hcv.json, pbv.json, mod_rehab.json) citing an id no file defined. This single record is deliberately the one definition of the subpart for both passes. If pending_voucher.json is later seen to re-add it, keep one and delete the other rather than renaming, because rules in both passes cite this id.

The document's own face carries month precision only — 'R. 01/26' and 'Effective 02/26' — so `published` is left null rather than manufacturing a day. Prescribed under Rule 12D-16.002, F.A.C., and covers all eight affordable-housing exemptions in one form: ss. 196.1978(1)(a), (1)(b), (2), (3), (4), 196.1979, 196.19781 and 196.19782. Page 1 states the filing rule for all of them: 'This completed application, including all required attachments, must be filed with the county property appraiser on or before March 1 of the current tax year.' Located from the state document library the agency's own manual designates -- DSHA's 2024 Monitoring and Compliance Manual, Appendix C, is a single page reading "Spectrum/Delaware / Form, Manuals, and Training" over https://spectrumlihtc.com/state-monitoring/delaware/. That page's "Required Forms" table is how the current edition was established. NO DATE: the form carries no revision line, no copyright line and no footer date, so `published` is null rather than invented. DSHA-branded (its title block reads "DELAWARE STATE HOUSING AUTHORITY / ANNUAL TENANT INCOME SELF-CERTIFICATION"), unlike the other three Delaware forms, which carry the delegate's copyright. Carries two operative rules that appear on no other Delaware artefact: item 2's stop-work instruction where a household member was added in the last twelve months, and a signature-block covenant that the household "agree(s) to immediately move if all members of the household become full time students and are ineligible". It also asks the asset-disposal question with the threshold on its face: "Has the family disposed of any assets valued at $1,000 or more in the last 2 years for less than Market value?" CURRENT EDITION, established from DSHA's own LIHTC program page (destatehousing.com/build/lihtc/), which lists exactly one compliance manual and links this file. Two other copies muddy search: (a) an earlier upload of the SAME February 2024 edition at /wp-content/uploads/2024/04/DSHA-Tax-Credit-Compliance-Monitoring-Manual-2024.pdf (85 pp, 1,833,385 bytes, different render so different hash, sha256 dad05e2528e450a92e2604e6cdf31ef436b1e9c97a1d9d9702ad31ce6ede6794); and (b) the SUPERSEDED 'Revised 06/11' edition, 146 pp, still HTTP 200 on 2026-08-25 at /wp-content/uploads/2024/02/dsha-tax-credit-compliance-monitoring-manual-11.pdf (sha256 8cd8e19afb742e5ae077603b5749ff3add971ab3432a4547414b2f246eb50a13) and ranked first by web search. The manual predates HOTMA implementation and does not mention it. Internal page numbers run ~4 lower than PDF page numbers; locators below cite the printed page. Note two conflicts with the 2025-2026 QAP that are encoded as open questions on the affected rules: correction period (manual 45 days, QAP 60) and upfront monitoring fee (manual $500/unit, QAP $750/$1,000). TWO ANNOTATIONS CORRECTED 2026-08-28. (1) 'The manual predates HOTMA implementation and does not mention it' is FALSE. The manual reproduces HUD's four-scenario net-family-assets table and the full HOTMA exclusion table, headed 'The following assets are excluded under HOTMA', and refers to 'HOTMA Regulation effective 1/1/2024'. It was missed because BOTH TABLES ARE PASTED SCREENSHOTS of a HUD training deck whose OCR text layer is corrupt exactly at the operative bullets: the $50,000 figures extract as '$5o,ooo*' and '$50,ooo,' with letter o's. A keyword search for '50,000' or 'HOTMA' finds neither. This is the no-text-layer trap in a new form -- a MANGLED extraction rather than an empty one, which gives no signal that anything is wrong. (2) 'Internal page numbers run ~4 lower than PDF page numbers' -- the offset is consistently 5, checked at 15 pages.

The document footer reads 08/13/10, but it is current in the operative sense: the February 2024 manual reproduces it nearly verbatim as ch. XXVI (pp. 66-68 printed). That reproduction is also why its UPCS inspection standard (item 8) survives into 2024 text while the same manual's compliance-period chapter (XVII) elects NSPIRE - a conflict encoded on de.lihtc.post_year_15_streamlined_monitoring rather than resolved.

Carries the public housing income-targeting requirement at subsec. (a), the deconcentration mandate at (a)(3)(B) that 24 CFR 903.2 implements, the HOTMA section 103 over-income regime at (a)(5) added by Pub. L. 114-201, and the HOTMA section 104 asset limits at subsec. (e) added by the same Act. A DISCREPANCY WORTH KNOWING: (a)(5)(C) states the over-income limitation as '120 percent of the median income for the area', while HUD's implementing regulation at 24 CFR 960.507(b) sets the over-income limit at the very-low-income limit multiplied by 2.4. Those are not arithmetically the same number wherever the published very-low-income limit is capped or adjusted, which is most large metropolitan areas. The regulation is what a PHA administers; the statute is what the regulation is written under.
24 CFR Part 576

Added because 24 CFR 578.103(a)(3) does not state the Continuum of Care homeless-status evidence standard -- it adopts 24 CFR 576.500(b) by reference -- so a CoC intake obligation cannot be cited without part 576. 'published' carries the latest amendment date eCFR's own versions metadata records for the part (2025-04-02), not a date inferred from the URL. 576.500's printed credit line reads: 76 FR 75974, Dec. 5, 2011, as amended at 80 FR 42368, July 16, 2015; 80 FR 75939, Dec. 7, 2015; 81 FR 80809, Nov. 16, 2016; 85 FR 47911, Aug. 7, 2020; 86 FR 30792, June 10, 2021; 90 FR 11024, Mar. 3, 2025. eCFR re-renders current text, so this source is NOT in the codified-law blind spot described in CLAUDE.md: an amendment moves the hash.
HUD Notice H 2013-06
Publisher: HUD Office of Multifamily Housing Programs
United States · Published 2013-03-08 · Last fetched 2026-09-06 · 1 linked current rules
SUBJECT, verbatim from the document: "Enterprise Income Verification (EIV) System". Issued March 8, 2013. Cross references 24 CFR 5.233, 5.236 and 5.659. Supersedes Notices H 2008-03, H 2009-20, H 2010-10 and H 2011-21. Expiry clause, verbatim: "This notice remains in effect until amended, revoked, or superseded." -- so it does not lapse on a date and its currency is a question about later notices, not about age. THIS RECORD REPLACES src.hud.notice_h_2013_21, WHICH NAMED THE WRONG NOTICE. That record was titled as the EIV notice while its id said H 2013-21; its own notes flagged the contradiction on 2026-08-27 and refused to attach a url rather than guess, which is what made this recoverable. Resolved 2026-09-03 by fetching both: H 2013-21, issued July 25, 2013, is "Implementation and approval of owner-adopted admissions preferences for individuals or families experiencing homelessness" and has nothing to do with EIV. The citation field was the half that was right. OPEN QUESTIONS (this schema has no provenance block, so they live here rather than being dropped): 1. Whether HUD Notice H 2023-10 or H 2025-07 amends any part of the EIV instructions in this notice. NOT established; both are in the corpus and neither has been read against this one. The freshness block carries the same question as a high supersession risk. 2. HUD Notice H 2013-21 -- owner-adopted admissions preferences for individuals or families experiencing homelessness, issued 2013-07-25 -- was fetched while resolving this and is NOT in the corpus. It states a real obligation about what an owner's Tenant Selection Plan must carry, and no rule here models it.

Cited here only for the provisions that gate a CDBG housing commitment: 58.4 (responsible entities assume HUD's NEPA responsibilities by grant agreement or HUD Form 7015.15), 58.22 (limitations on activities pending clearance - no commitment of HUD assistance, and no commitment of non-HUD funds on a choice-limiting action, until HUD or the State approves the RROF and certification; exempt and categorically excluded activities need no RROF; the nominal-cost option agreement carve-out at 58.22(d); the relocation carve-out at 58.22(f)), 58.71 (the RROF and certification are executed by the Certifying Officer). 'published' carries the most recent amendment date printed in the part's source credits (89 FR 30913, 23 April 2024). eCFR re-renders current text, so this source is NOT in the codified-law-cited-as-a-fixed-file blind spot described in CLAUDE.md.
24 CFR Part 247

United States · Published 2026-03-13 · Last fetched 2026-09-06 · 3 linked current rules
'published' carries the LATEST AMENDMENT DATE eCFR records for part 247 (2026-03-13). 24 CFR 247.2 defines 'subsidized project' to include a project receiving interest reduction payments under section 236, and to include units receiving rent supplement payments or project-based Section 8 -- but expressly NOT project-based Section 8 under 24 CFR parts 880, 881, 883 and 884 except as those parts provide. That carve-out is why this corpus cites 880.607 for PBRA terminations and part 247 for Section 236 and 221(d)(3) BMIR terminations. TWO PENDING CHANGES the rendered text itself flags on 24 CFR 247.4: 'Link to an amendment published at 91 FR 9452, Feb. 26, 2026' and 'This amendment was delayed indefinitely at 91 FR 12301, Mar. 13, 2026'. Neither Federal Register document was retrieved for this pass, so what the amendment does and how long the delay runs are OPEN. 24 CFR 247.4's own source credit ends '89 FR 101302, Dec. 13, 2024'.
