The OPERATOR of a project for which a 142(d) election was made must submit an annual certification to the Secretary as to whether the project continues to meet the requirements of section 142(d). The IRS prescribes Form 8703 for this. It is filed by March 31 after the close of the calendar year certified, annually throughout the qualified project period, with the IRS Service Center at Ogden, Utah, and a separate Form 8703 is required for each project. The certification in Part IV is made under penalties of perjury by the project operator, who may or may not be the owner: Rev. Proc. 2014-50 defines the operator as the person to whom the issuer or owner delegates responsibility for keeping the project qualified. This filing goes to the IRS on a calendar-year cycle. It is not the section 42 owner annual certification under 26 CFR 1.42-5(c), which goes to the state allocating agency on the agency's own schedule, and neither filing discharges the other.
