A low- and moderate-income household for CDBG purposes is a household having an income equal to or less than the Section 8 low-income limit established by HUD, and a low- and moderate-income person is a member of a family with an income at or below that limit, with unrelated individuals counted as one-person families. A low-income household is one at or below the Section 8 very low-income limit. HUD publishes the CDBG income limits annually; the FY 2026 CDBG income limits are effective June 1, 2026. The binding figure is the published limit for the area and household size and is not derivable from the regulation.
CDBG's vocabulary inverts the intuition an LIHTC or HOME specialist brings: in part 570 'low- and moderate-income' is the BROADER category (Section 8 low-income, conventionally 80 percent of area median) and 'low-income' is the narrower one (Section 8 very low-income, conventionally 50 percent).
