Housing leased with Continuum of Care funds, or for which rental assistance payments are made with them, must meet the applicable standards under 24 CFR 5.703, except that the carbon monoxide detection requirement at 5.703(b)(2) and (d)(6) does not apply. BEFORE any assistance is provided on behalf of a program participant the recipient or subrecipient must PHYSICALLY INSPECT each unit to assure it meets 5.703, and assistance will not be provided for a unit that fails unless the owner corrects the deficiencies WITHIN 30 DAYS of the initial inspection and the recipient or subrecipient verifies that all deficiencies have been corrected. Recipients or subrecipients must inspect all units AT LEAST ANNUALLY during the grant period to ensure they continue to meet 5.703. The requirements in 24 CFR 5.705 through 5.713 -- the NSPIRE frequency, scoring, ranking and appeal machinery -- do not apply. For tenant-based rental assistance, for leasing of individual units, and for sponsor-based assistance where not all units in a structure are assisted, the standards reach only the unit itself and the means of ingress and egress from the unit to the public way and to the building's common areas. The unit must have at least one bedroom or living/sleeping room for each two persons, and children of opposite sex other than very young children may not be required to share one. Documentation of compliance, including inspection reports, must be retained.
