Assistance is restricted where net family assets exceed the statutory limit or the family owns suitable real property

Assistance may not be provided, either initially or upon reexamination of family income, to a family whose net assets exceed $100,000 as adjusted annually by HUD, or to a family that has a present ownership interest in, a legal right to reside in, and the effective legal authority to sell real property suitable for occupancy as a residence, subject to the enumerated exceptions. A PHA may choose not to enforce the restrictions at recertification, or may establish exceptions, only pursuant to an adopted written policy.
24 CFR 5.618(d) permits, but does not require, the PHA to delay eviction or termination for up to six months for noncompliance with this provision.
