The tenant and owner must execute a written lease. All provisions in the HUD-required tenancy addendum must be added word-for-word to the owner's standard form lease used for unassisted tenants. The tenant may enforce the tenancy addendum against the owner and its terms prevail over any other provision of the lease. The lease must specify the parties, the unit, the term, the monthly rent to owner, and which utilities and appliances the owner and the family each supply.
A change in which party pays a utility, or in the lease term, requires PHA approval of a new tenancy and a new HAP contract under 982.308(g)(2); an ordinary lease amendment does not.
