A receiving PHA must administer assistance for an incoming portable family under its own policies

When a family moves under portability to an area outside the initial PHA's jurisdiction, the receiving PHA must administer assistance for the family and cannot refuse to assist an incoming portable family or direct it to a neighbouring PHA. The receiving PHA does not redetermine eligibility for a participant family, administers the voucher under its own policies rather than its preferences or waiting list, determines family unit size under its own subsidy standards, and must issue a voucher whose term does not expire earlier than 30 calendar days after the initial PHA voucher expires.
982.355(e)(3) fixes the billing reimbursement at the lesser of 80 percent of the initial PHA's ongoing administrative fee or 100 percent of the receiving PHA's, unless the two agencies negotiate a different amount.
