Rent to owner must be determined reasonable before lease approval and may never exceed the current reasonable rent

The PHA may not approve a lease until it determines that the initial rent to owner is reasonable in comparison to rent for other comparable unassisted units, considering location, quality, size, unit type and age, and the amenities, services, maintenance and utilities the owner provides. The PHA must redetermine reasonable rent before any increase in rent to owner, and where the published FMR has fallen 10 percent as measured 60 days before the contract anniversary. At all times during the assisted tenancy the rent to owner may not exceed the most recent reasonable rent determination.

The owner's certification under 982.507(d) is made by the act of accepting each monthly HAP; it is not a separate signed document, which is why owners are frequently unaware they have made it.
