At initial occupancy the family share may not exceed 40 percent of adjusted monthly income

At the time the PHA approves a tenancy for initial occupancy, where the gross rent of the unit exceeds the applicable payment standard for the family, the family share must not exceed 40 percent of the family's adjusted monthly income. The adjusted monthly income used must be based on verification information received no earlier than 60 days before the PHA issued the voucher.
A recurring error is applying the 40 percent cap at every reexamination. It is an admission test only.
