The PHA must offer a participant an informal hearing on the enumerated decisions before terminating assistance

The PHA must give a participant family the opportunity for an informal hearing on a determination of the family's annual or adjusted income and its use to compute the housing assistance payment, the appropriate utility allowance, the family unit size under the PHA subsidy standards, a determination to terminate assistance for the family's action or failure to act, and a determination to terminate for absence from the unit. Where the decision is a termination the opportunity must be given before the PHA terminates housing assistance payments under an outstanding HAP contract. The hearing may not be conducted by the person who made or approved the decision or a subordinate of that person, and the hearing officer must issue a written decision on a preponderance of the evidence.
