HOME leases must be at least one year and must not contain prohibited provisions

The lease between the owner and a HOME tenant must be for at least one year unless the tenant and owner mutually agree otherwise, and must not contain any of the provisions prohibited by the HOME regulation, including agreements to be sued without notice, confession of judgment, and waiver of legal proceedings before eviction.

The 2025 HOME final rule added further lease and tenant protection provisions; the April 2026 supplemental rulemaking reverts several of them. Verify which text is in force for the certification date being tested before relying on the added provisions.
