A HOPWA-assisted building stays housing or assistance for persons with AIDS for ten years after new construction, substantial rehabilitation or acquisition, and three years otherwise

Any building or structure assisted with HOPWA funds must be maintained as a facility to provide housing or assistance for individuals with acquired immunodeficiency syndrome or related diseases for a period of not less than TEN YEARS where the assistance involved new construction, substantial rehabilitation or acquisition of a building or structure, and not less than THREE YEARS in cases involving non-substantial rehabilitation or repair. HUD may waive the minimum use period only if the grantee demonstrates to HUD's satisfaction both that the assisted structure is no longer needed to provide supported housing or assistance, or that its continued operation for those purposes is no longer feasible, AND that the structure will be used to benefit individuals or families whose incomes do not exceed 80 percent of area median as determined by HUD with adjustments for family size. Both limbs are required for a waiver.
