An eligible person under HOPWA is a person with acquired immunodeficiency syndrome or related diseases who is a LOW-INCOME INDIVIDUAL as defined in section 853(3) of the AIDS Housing Opportunity Act, together with that person's family. Both halves are required for housing assistance: HIV or AIDS status alone does not qualify a household, and low income alone does not either. 'AIDS or related diseases' is defined to mean the disease of acquired immunodeficiency syndrome or any conditions arising from the etiologic agent for AIDS, including infection with the human immunodeficiency virus, so a person living with HIV who has not progressed to an AIDS diagnosis is within the definition. Family is defined in 24 CFR 5.403 and expressly includes one or more eligible persons living with another person or persons, regardless of actual or perceived sexual orientation, gender identity or marital status, who are determined to be important to the eligible person or that person's care or well-being, and includes the surviving members of such a family. Two activities are open regardless of income: housing information services under 24 CFR 574.300(b)(1) may be provided to a person with AIDS or related diseases or a family member regardless of income, and anyone living in proximity to a community residence may take part in its outreach and educational activities.
