Responsibility does not pass through with the money. GRANTEES ARE RESPONSIBLE FOR ENSURING THAT GRANTS ARE ADMINISTERED in accordance with the requirements of this part and other applicable laws, and RESPONSIBLE FOR ENSURING THAT THEIR RESPECTIVE PROJECT SPONSORS CARRY OUT ACTIVITIES IN COMPLIANCE with all applicable requirements. Upstream of that, the grantee SHALL ENSURE THAT ANY PROJECT SPONSOR with which it contracts HAS THE CAPACITY AND CAPABILITY TO EFFECTIVELY ADMINISTER THE ACTIVITY -- a pre-contract judgement the grantee must be able to evidence, not a representation it may accept. The grant agreement carries the operating duties down to each sponsor: to operate the programme in accordance with these regulations and other applicable HUD regulations, TO CONDUCT AN ONGOING ASSESSMENT OF THE HOUSING ASSISTANCE AND SUPPORTIVE SERVICES REQUIRED BY THE PARTICIPANTS, to assure the adequate provision of supportive services to them, and to comply with recordkeeping and reporting terms HUD establishes, WHICH MUST INCLUDE RACIAL AND ETHNIC DATA ON PARTICIPANTS. HUD enforces those obligations under 2 CFR part 200 subpart D, and a grantee gets an opportunity for informal consultation before HUD exercises a remedy.
