Each recipient of HOPWA assistance must provide safe and sanitary housing in compliance with all applicable State and local housing codes, licensing requirements and any other jurisdictional requirements regarding the condition of the structure and the operation of the housing. Except for variations the grantee proposes and HUD approves, the housing must meet the standards for HUD housing in 24 CFR 5.703, with two adaptations: 'HUD housing' means the units eligible persons occupy or will occupy, systems equipment directly servicing those units, items and components within the primary and secondary means of egress from those units' doors to the public way, and common features related to residential use such as the laundry room, community room and mail room; and housing that continues to meet the HOPWA housing quality standards that applied when the eligible persons moved in is NOT required to meet new or different standards under 5.703. The requirements of 24 CFR 5.705 through 5.713 -- the NSPIRE inspection frequency, scoring, ranking and appeal machinery -- DO NOT APPLY. A HOPWA property is therefore held to the NSPIRE condition standards without the NSPIRE inspection cycle, which is the single most common mistake made when a HOPWA project sits alongside a HUD Multifamily one.
