For purposes of determining resident rent payments, grantees conduct a reexamination and redetermination of family income and family composition EVERY YEAR. A family may request an interim reexamination because of any change since the last determination, and the grantee must make it within a reasonable time -- generally not exceeding 30 days from the date the family reports the change. The grantee MAY DECLINE an interim reexamination where it estimates the family's adjusted income will decrease by less than ten percent of annual adjusted income, or a lower threshold the grantee sets. The grantee MUST conduct one when it becomes aware that adjusted income has changed by an amount it estimates will produce an increase of ten percent or more, except that it may not count any increase in EARNED income unless the family previously received an interim reduction during the certification period, and may choose not to reexamine in the last three months of a certification period. Rent increases following a timely reported change take effect after 30 days advance notice; where the family failed to report timely, increases are implemented retroactively to the first of the month following the change. A determination off by no more than $30 per month in monthly adjusted income is a de minimis error that does not put the grantee out of compliance, but the grantee must still correct it and credit or repay an overcharged family, and families are not required to repay an undercharge.
