The VAWA requirements of 24 CFR part 5 subpart L apply to housing assisted with HOPWA funds for acquisition, rehabilitation, conversion, lease and repair of facilities, new construction and operating costs, and to project-based, sponsor-based and tenant-based rental assistance and community residences; they do not apply to short-term supported housing except that no individual may be denied admission to or removed from it because the individual is or has been a victim. The grantee is responsible for ensuring that each project sponsor, or itself where it administers directly, sets a policy determining the reasonable grace period for remaining persons in the unit to establish HOPWA eligibility or find alternative housing -- NO LESS THAN 90 CALENDAR DAYS AND NO MORE THAN ONE YEAR from the date of bifurcation of a lease -- provides the notice of occupancy rights and certification form at the times listed in 574.604(d), adopts and administers an emergency transfer plan developed under 24 CFR 5.2005(e), and maintains the confidentiality of documentation submitted with transfer requests and of each tenant's housing location. The grantee or project sponsor must also ensure the housing or facility owner or manager develops and uses a VAWA lease term or addendum incorporating the requirements that apply to it, which must provide that the tenant may terminate the lease without penalty on qualifying for an emergency transfer. Housing assistance and supportive services continue for the remaining persons throughout the grace period, and they must be told its duration.
