HTF affordability restrictions revive if the pre-foreclosure owner or a related party reacquires the property

htf.affordability_period.restrictions_revive_on_reacquisition · v1.0.0

Where the HTF affordability restrictions terminated on foreclosure or on a transfer in lieu of foreclosure, they are revived according to their original terms if, during the original affordability period, the owner of record before the foreclosure or deed in lieu of foreclosure, or any entity that includes the former owner or those with whom the former owner has or had family or business ties, obtains an ownership interest in the project or property.

'Family or business ties' is not defined in part 93, so identifying a related-party reacquisition is a documentary judgement about the acquiring entity's ownership, not a lookup.
