HTF funds not used to meet the extremely low-income target must benefit very low-income families

In any fiscal year in which the total amount available for allocation of HTF funds is less than $1 billion, the grantee must use 100 percent of its HTF grant for the benefit of extremely low-income families or families with incomes at or below the poverty line, whichever is greater; in any fiscal year in which more than $1 billion is available, at least 75 percent must be so used. Any grant funds not used in accordance with that requirement must be used for the benefit of very low-income families, meaning families whose annual incomes exceed 30 percent but do not exceed 50 percent of area median income as determined by HUD, with adjustments for smaller and larger families. There is no third tier: an HTF-assisted unit is either an extremely low-income unit or a very low-income unit.

Whether a very low-income unit is available at all is a function of the fiscal year's national allocation, which is a fact about the grant year and not about the property. HUD's own income limits publication says the very low-income column is simply omitted in years below the $1 billion threshold, so the absence of a published VLI limit for a year is evidence that no VLI units were permitted for that year's funds.
