The lease for an HTF-assisted rental unit may not contain any of the nine provisions prohibited by 24 CFR 93.303(b): agreement by the tenant to be sued, to admit guilt or to a judgment in the owner's favour; agreement that the owner may take, hold or sell household members' personal property without notice and a court decision; agreement not to hold the owner or its agents legally responsible for any action or failure to act; agreement that the owner may sue without notice; agreement that the owner may evict without a civil court proceeding in which the tenant may present a defence; waiver of a jury trial; waiver of the right to appeal or otherwise challenge a court decision; agreement to pay the owner's attorney's fees or legal costs even where the tenant wins; and agreement to accept supportive services that are offered.
