An HTF unit stays qualified through a tenant's income increase only while vacancies are being filled to correct the noncompliance

HTF-assisted units continue to qualify as affordable housing despite a temporary noncompliance caused by increases in the incomes of existing tenants, if actions satisfactory to HUD are being taken to ensure that all vacancies are filled in accordance with 24 CFR 93.302 until the noncompliance is corrected. The qualification is conditional on the corrective action actually being underway, not on the passage of time.

An over-income HTF tenant may not be evicted for that reason: 93.303(c) says good cause does not include an increase in the tenant's income. The cure runs through the next available units, not through the sitting household.
