The binding HTF rent ceiling is the HUD-published HTF rent limit for the year, area and bedroom count

The HTF rent plus utilities of an extremely low-income tenant may not exceed the GREATER of 30 percent of the federal poverty line or 30 percent of the income of a family whose annual income equals 30 percent of area median income, with adjustments for the number of bedrooms in the unit. For a very low-income tenant the ceiling is 30 percent of the income of a family whose annual income equals 50 percent of area median income, similarly adjusted. HUD publishes the HTF rent limits annually; the binding figure for a given year, area and bedroom count is the published limit and cannot be derived from the regulation alone.

CORRECTED 2026-08-31. This record previously read 'the lesser of 30 percent of the federal poverty line or 30 percent of the income of a family at 30 percent of area median ... and in no case may exceed the applicable Fair Market Rent.' 24 CFR 93.302(b)(1)(i) says GREATER, and part 93 contains no Fair Market Rent cap at all. Both errors pushed the ceiling down, so the rule would have reported a compliant property as over the HTF rent limit -- a violation against a property that did not have one. Verified twice: against the eCFR text of 93.302 fetched this session, and against HUD's own published file, where by_bedroom_count equals the element-wise greater of the two components in 4,645 of 4,645 comparable rows and carries no FMR component. The prior locator '93.302(b)' is narrowed to the paragraph that actually states each tier.
