Where the unit carries project-based rental subsidy and the tenant pays no more than 30 percent of adjusted income, the subsidy program's rent is the maximum

If an HTF-assisted unit receives Federal or State project-based rental subsidy and the tenant pays as a contribution toward rent not more than 30 percent of the tenant's adjusted income, the maximum rent for that unit is the rent allowable under the Federal or State project-based rental subsidy program rather than the published HTF rent limit. Both conditions must hold: project-based subsidy alone does not lift the HTF ceiling if the tenant contribution exceeds 30 percent of adjusted income.
Part 93 does not require the grantee to calculate adjusted income, so the 30 percent test here is normally satisfied out of the subsidy programme's own certification (HUD-50059, HUD-50058) rather than a separate HTF calculation.
