HTF units must be designated fixed or floating at commitment and identified by project completion

In a project containing both HTF-assisted and other units, the grantee may designate the HTF units as fixed or floating. The designation must be made at the time of project commitment in the written agreement between the grantee and the recipient, and the HTF units must be identified not later than the time of project completion. Fixed units remain the same throughout the period of affordability. Floating units must be changed to maintain conformity so that the total number of conforming units stays the same, and each substituted unit must be comparable in size, features and number of bedrooms to the originally designated unit.
The designation is the hinge for every downstream per-unit test. On a floating project a unit-level rent or income finding is only meaningful once the current substitution set is known, which is why 93.404(c)(2)(ix) requires the owner to report substitutions.
