Only an Indian tribe, or a tribally designated housing entity (TDHE) when authorized by one or more Indian tribes, may be the recipient of an Indian Housing Block Grant. An Indian tribe designates itself as recipient by resolution of the tribe, or by resolution or other written form of a tribal committee to which the governing body has delegated that authority. A TDHE is designated the same way by the tribe or tribes to be served; in the absence of a designation by the tribe, the default designation in section 4(21) of NAHASDA applies. The corpus's state-agency and PHA overlays do not reach an IHBG property: the administering body is the tribe or its TDHE, and its authority rests on a tribal instrument, not a state one.
