The minimum initial lease term is one year in the Section 8 and Section 202/811 programs and one month in Section 236, BMIR, RAP and Rent Supplement

The required lease term is set per program by Figure 6-4. Section 8 New Construction, Substantial Rehabilitation, State Agency, RHS 515 with Section 8, Section 202 with Section 8, Section 202 with PAC, Section 202 with PRAC and Section 811 with PRAC all take a minimum initial term of one year; the Section 8 New Construction, Substantial Rehabilitation, State Agency and RHS 515 leases then renew for a minimum of 30 days, while the 202 and 811 leases renew automatically for successive one-month terms. Section 236, Section 221(d)(3) BMIR, RAP and Rent Supplement properties take a minimum of one month and a maximum of one year, initial and renewal alike. Section 8 LMSA and Property Disposition take the lesser of one year or the remaining term of the HAP contract. The one-year minimum may be shortened only where the Section 8 HAP contract will expire in less than 12 months from the lease's effective date, in which case the owner should execute a lease running to the end of the contract.
