An owner modifies the lease only by addendum and only after prior written HUD or Contract Administrator approval

An owner may modify the terms and conditions of the lease only in the form of a lease addendum, and must receive the prior written approval of HUD or the Contract Administrator before providing the modification to tenants. Changes to the Model Lease for Subsidized Programs may be made only for documented state or local laws, or for a management practice generally used by management entities of assisted projects. A lease change HUD itself issues -- through a Notice or a revision to this handbook -- is incorporated as an addendum and does not require Field Office or Contract Administrator approval, but the tenant must still be given notice. Where a model lease provision conflicts with state or local law, the owner must follow whichever rule is of most benefit to the tenant.
