Nine provisions of the Model Lease for Subsidized Programs may not be modified at all

HUD permits an owner to modify the Model Lease for Subsidized Programs only with approval and only by addendum, but nine of its provisions are off limits to modification entirely: Changes in Tenant Rent; Regularly Scheduled Recertifications; Reporting Changes between Regularly Scheduled Recertifications; Removal of Subsidy; Tenant Obligation to Repay; Discrimination Prohibited; Changes in Rental Agreement; Termination of Tenancy; and Penalties for Submitting False Information. The Model Leases for Section 202/8, Section 202 PACs, Section 202 PRACs and Section 811 PRACs are more tightly constrained still: they may be modified only for documented state or local laws, or as the handbook itself specifies.

HUD Handbook 4350.3 REV-1 was last amended by Change 4, issued 27 November 2013, and has not been reissued since. HUD's HOTMA implementing rule and its implementing notices (H 2023-10 and successors) govern wherever they conflict with this handbook paragraph.
