When the owner or a third party causes the delay, the assistance payment still changes on the anniversary date but a rent increase waits for the 30-day notice

Where the owner failed to give timely recertification reminder notices, or had adequate time but failed to complete verification and processing 30 days before the anniversary date and so could not give the required 30-day notice, changes in the assistance payment still take effect on the recertification anniversary date. Changes in total tenant payment and tenant rent take effect on the anniversary date if the rent decreases, and on the first of the month following a 30-day notice period if the rent increases. The same split applies where the tenant responded on time but verification could not be completed in time: the HAP change is effective on the anniversary date and the rent increase may not take effect until the 30-day notice period has expired. A rent decrease never requires 30 days notice; both the tenant's rent and the HAP change on the anniversary date. Where everything is completed on time, all three -- total tenant payment, tenant rent and assistance payment -- take effect on the anniversary date.
