A tenant who has had all three reminder notices and reports on or after the anniversary date begins paying market rent on that date, and assistance resumes only prospectively

Where the owner gave all three reminder notices in accordance with HUD requirements and the tenant reports for the recertification interview on or after the recertification anniversary date, the tenant must begin paying the market rent on the anniversary date -- the Section 236 market rent in a 236 project, the BMIR market rent in a BMIR project. Assistance should be reinstated if assistance is available at the property, the tenant submits the required information, and the owner determines the tenant qualifies. The new total tenant payment, tenant rent and assistance payment then take effect on the first day of the month following the date the tenant reported, and the tenant pays market rent until that date; if the owner finishes processing during that following month, the change is applied retroactively to that same effective date. A tenant who neither reports nor pays market rent nor makes arrangements to pay leaves the owner obligated to evict for nonpayment. In a Section 202 PRAC or Section 811 PRAC project the tenant will instead be evicted for failing to comply with the recertification requirements, paying the greater of operating rent or 30 percent of income until eviction procedures are complete.
