An owner may reinstate a tenant's terminated assistance where five conditions are met together: the original termination was due either to the tenant's failure to recertify or to the tenant's increased ability to pay; the original termination was not due to fraud; the tenant is eligible for assistance, meaning that on the income and rent calculation the tenant would pay less than market rent; the tenant submits the required information; and assistance is available for the unit. Reinstatement is permissive rather than mandatory, and it operates prospectively -- the recertification rules put the new tenant payment and assistance payment into effect on the first day of the month following the date the tenant reported.
