Where the owner determines that a tenant's current unit is smaller or larger than appropriate because of a change in family size or composition, the owner must decide whether to require a transfer -- but must not reduce or terminate the assistance payment associated with the original unit until the family has been offered a transfer to a unit of appropriate size and has been given sufficient time, no less than 30 days, to move. Under the Model Lease for Subsidized Programs a tenant told a transfer is required may either remain in the unit and pay the HUD-approved market rent, or move within 30 days after the owner notifies the family that a unit of the required size is available in the property. Whether a transfer is required turns on whether an appropriately sized unit exists in the property, whether there is a market for the size of unit being vacated, and how long the tenant will remain -- a tenant who has given written notice to vacate need not be required to transfer. Depending on the circumstances the tenant may be obligated to pay the costs of the move, except that where the transfer is a reasonable accommodation to a household member's disability the owner must pay them unless doing so would be an undue financial and administrative burden.
