On a unit transfer both the rent change and the assistance payment change take effect the day the tenant actually occupies the new unit

In the case of a unit transfer, both the change in rent and the change in the assistance payment are effective on the day the tenant actually occupies the new unit -- not on the date of the transfer offer, not on the date the new lease is signed, and not on the first of the following month. Because a transfer within the same property does not move the recertification anniversary date, the transfer certification and the annual recertification remain on separate clocks. The owner and all tenants required to sign the lease must sign a lease for the new unit. On the security deposit the owner has a choice: transfer the existing deposit to the new unit, or charge a new deposit and refund the deposit for the old unit, in which case the refund follows the ordinary refund rules and the new deposit is set under the ordinary collection rules.
