Vacant contract units must be filled from the PHA waiting list, with in-place families admitted without being listed

All vacant units under contract must be rented to eligible families referred by the PHA from its waiting list. The PHA must select families in accordance with the program and its approved application, including any PHA preferences, and must select families eligible for housing assistance payments who already reside in units designated for rehabilitation without requiring them to be placed on the waiting list. If the PHA cannot refer enough interested applicants within 30 days of the owner's notice of a vacancy, the owner may advertise or solicit applications and refer families to the PHA for an eligibility determination. The owner is responsible for tenant selection and may refuse a family provided it does not unlawfully discriminate, and must not deny assistance or admission because an applicant is or has been a victim of domestic violence, dating violence, sexual assault or stalking.

882.514(d) additionally requires the PHA to brief each family on tenant rent, the utility allowance schedule, the fact that the subsidy is tied to the unit, and the family's options if it must move because of a change in family size.
