Where the owner breaches the contract and the unit is terminated, a blameless family must be offered tenant-based assistance

Where an owner evicts an assisted family in violation of the contract or otherwise breaches the contract, the contract for the unit is terminated, and the family was not at fault and remains eligible for continued assistance, the family may continue to receive assistance through conversion of the Moderate Rehabilitation assistance to tenant-based assistance under the Section 8 voucher program. The family must then be issued a voucher, treated as any tenant-based participant under 24 CFR part 982, and assisted by the PHA in finding a suitable unit, except that the term of any housing assistance payments contract may not extend beyond the term of the initial Moderate Rehabilitation contract. The unit remains under the Moderate Rehabilitation ACC, which provides for the conversion, so no ACC amendment is needed.
