Vacancy payments run at 80 percent of Contract Rent for a bounded period and only where the owner met the notice and re-rental conditions

Where a rehabilitated contract unit is not leased within 15 days of the effective date of the contract, the owner is entitled to housing assistance payments of 80 percent of the Contract Rent for a vacancy period not exceeding 60 days from the effective date, provided the owner has taken and continues to take all feasible actions to fill the vacancy and has not rejected any eligible applicant except for good cause acceptable to the PHA. After initial occupancy, where an eligible family vacates other than through owner action violating the lease, contract or law, the owner may receive the payment due for so much of the month as the unit remains vacant and then 80 percent of the Contract Rent for a vacancy period not exceeding an additional month, but only if the owner notified the PHA of the vacancy immediately on learning of it and continues to take those same actions. Any of the family's share of rent the owner collects for that period reduces the payment so the total does not exceed 80 percent of the Contract Rent, and the excess must be reimbursed to the PHA. The owner is not entitled to vacancy payments where it is entitled to payment for the same vacancy from another source.
