Rent to owner must be redetermined on the stated triggers and any increase takes effect only at the contract anniversary

The PHA must redetermine the rent to owner when there is a 10 percent decrease in the published FMR, on the owner's request consistent with the PHA Administrative Plan, and at the time of an automatic operating cost adjustment factor adjustment. Any increase in rent to owner goes into effect at the annual anniversary of the HAP contract. Where the contract does not provide for an OCAF adjustment, an owner seeking an increase must request it at the annual anniversary by written notice. A decrease required by 983.301 must be made whether or not the owner requests an adjustment.
