Assistance payments cease when tenant rent equals rent to owner, and the unit leaves the contract after 180 days

Housing assistance payments continue until the tenant rent equals the rent to owner. Cessation at that point does not affect the family's other rights under its lease and does not preclude resumption of payments if income, rents or other relevant circumstances change within 180 days following the date of the last housing assistance payment. After the 180-day period the unit must be removed from the HAP contract under 983.211.

Contrast the Mod Rehab formulation at 882.515(d), where eligibility continues until total tenant payment equals GROSS rent rather than rent to owner.
