The public housing lease runs 12 months and renews automatically except for community service noncompliance

A lease must be entered into between the PHA and each tenant of a dwelling unit. The lease must have a twelve month term and, except where the family has violated the community service requirement, must be automatically renewed for the same period. The lease must be executed by the tenant and the PHA except for automatic renewals, and may be modified at any time by written agreement of the tenant and the PHA. The PHA may not renew the lease if the family has violated the requirement for resident performance of community service or participation in an economic self-sufficiency program. The lease converts to a month-to-month term for a family determined to be over-income whose tenancy will be terminated, as of the date of the 24-month over-income notice. The lease must state the names of the PHA and the tenant, the unit rented, the term, what utilities, services and equipment the PHA supplies without additional cost and what the tenant pays for, the composition of the household as approved by the PHA, and that 24 CFR part 5 subpart L applies; and the family must promptly inform the PHA of the birth, adoption or court-awarded custody of a child and must request PHA approval to add any other family member as an occupant. Before adopting a new lease form the PHA must give at least 30 days notice to tenants and resident organisations setting out the proposed changes and providing an opportunity to present written comments, and must consider comments received before formal adoption. Charges for maintenance and repair beyond normal wear and tear and for consumption of excess utilities are not due and collectible until two weeks after the PHA gives written notice, and that notice is a notice of adverse action.
