Reexamination cadence follows the rent the family pays, and over-income families are examined on their own clock

For families who pay an income-based rent the PHA must conduct a reexamination of family income and composition at least annually and must make appropriate adjustments in the rent after consultation with the family and on verification of the information. For families who choose flat rents the PHA must conduct a reexamination of family composition at least annually and a reexamination of family income at least once every three years, except for families the PHA determines exceed the over-income limit, for whom the income examination and notification requirements of 24 CFR 960.507(c) apply instead. For all families that include nonexempt individuals the PHA must determine compliance with the community service and self-sufficiency requirements once each twelve months. The PHA may use the results of these reexaminations to require the family to move to an appropriate size unit. For all non-public housing over-income families the PHA may not conduct an annual reexamination of family income. Where a family chooses the flat rent option in a year in which the PHA does not conduct a full examination, the PHA must use income information from the examination made at the first annual rent option, inform the family of the updated flat rental amount and of the rental amount produced by the most recent examination, inform the family of its policies on switching rent types in circumstances of financial hardship, and apply the family's rent decision at the next lease renewal.
