An interim reexamination is required on a ten percent rise in adjusted income, with earned income excluded from the test

The PHA must conduct an interim reexamination of family income when it becomes aware that the family's adjusted income has changed by an amount the PHA estimates will result in an increase of ten percent or more in annual adjusted income, or such other amount as HUD establishes by notice. In estimating or calculating whether adjusted income has increased, the PHA may not consider any increase in the family's earned income, except that a PHA with an established written policy may consider increases in earned income where it has already processed an interim reexamination for a decrease in the family's income within the same reexamination cycle. The PHA may choose, in accordance with an established written policy, not to conduct an interim reexamination in the last three months of a family's certification period. A family may request an interim reexamination because of any change since the last determination, and the PHA must conduct it within a reasonable period of time after the request or after becoming aware of a qualifying increase, which generally should not be longer than 30 days after changes in income are reported. The PHA may decline to conduct an interim reexamination where it estimates the family's adjusted income will decrease by less than ten percent, or a lower threshold set by HUD or by the PHA. Where the family reported the change in a timely manner the PHA must give 30 days advance notice of any rent increase, effective the first day of the month after that 30-day period, while a rent decrease is effective the first day of the first month after the date of the actual change. Where the family failed to report in a timely manner the PHA must implement the resulting rent increase retroactively to the first of the month following the change, and must implement any resulting decrease no later than the first rent period following completion of the reexamination.
