A nonpayment termination notice must give 30 days and itemise how the tenant can cure

The lease must contain a provision or addendum that tenants will receive notification at least 30 days before an eviction for nonpayment of rent is filed. The PHA must not provide a termination notice before the day after the rent is due according to the lease, and must not proceed with filing an eviction if the tenant pays the alleged amount of rent owed within the 30-day notification period. Every termination notice for failure to pay rent must also include instructions on how the tenant can cure the nonpayment violation, including an itemised amount of alleged rent owed separated by month, any other arrearages allowed by HUD and included in the lease separated by month, and the date by which the tenant must pay before an eviction for nonpayment can be filed; information on how the tenant can recertify their income under 24 CFR 960.257(b), request a hardship exemption under 24 CFR 5.630(b), or request to switch from flat rent to income-based rent under 24 CFR 960.253(g); and, in the event of a Presidential declaration of a national emergency, such information as the Secretary requires.

A SPECIALIST READING THIS IN 2026 SHOULD KNOW THE POSTURE, NOT JUST THE RULE. The 30-day nonpayment notice looks revoked if you search the Federal Register and stop at the February 2026 interim final rule. It is not. The revocation's effective date was delayed indefinitely two weeks later under 5 U.S.C. 705 because of Jane Addams Senior Caucus v. HUD, 1:26-cv-00718 (D.D.C.), and HUD stated that the interim final rule 'will never come into effect'. eCFR prints the requirement as current text with a cross-reference to both documents.
