A PBRA conversion carries a 20-year HAP contract adjusted by OCAF and a 20-year RAD Use Agreement that renews with it

Where a PHA converts assistance to PBRA, contract rents are established under the RAD Notice and adjusted annually by HUD's published operating cost adjustment factor at each anniversary of the HAP contract, subject to the availability of appropriations. The initial contract runs 20 years and is subject to annual appropriations. At expiration of the initial contract and each renewal, HUD must offer and the project owner must accept a renewal contract for the prescribed number and mix of units. Each Covered Project with a PBRA HAP contract is subject to a 20-year RAD Use Agreement that renews with the HAP contract on the property the contract assists.
The RAD Use Agreement survives abatement or termination of the HAP contract, which is why it, and not the HAP contract, is the instrument to read for the length of the affordability restriction on a converted property.
