A PBRA conversion requires the HUD Model Lease with a RAD addendum, HUD-reviewed House Rules, no new security deposit and no new pet ban for sitting residents

PHAs must give residents notice of public housing lease termination under 24 CFR 966.4(l)(3) and in accordance with local law, and must enter into new Section 8 leases effective as of the effective date of the HAP contract. A sample Section 8 tenant lease with all riders and addenda, including the House Rules, must be in the RAD Closing package for HUD review. For a PBRA conversion the PHA must use the HUD Model Lease, Form HUD-90105a, with an approved RAD lease addendum. The lease terms and provisions, including every addendum and referenced document such as House Rules, must be reasonable, use plain language, and must not conflict with the resident rights described in the RAD Notice or with PBRA programme requirements; must be available in multiple languages as needed and written accessibly for people with disabilities; must not require a new security deposit from residents in place at conversion; must not prohibit the pets of residents in place at conversion; and must comply with the Lead Disclosure Rule for any residence that is target housing. HUD may reject or require revision of leases it deems unreasonable. The Resident Procedural Rights addendum at Attachment 1E must be part of the House Rules and the House Rules must be submitted to HUD for review before closing.
