A PBRA Project Owner must keep serving converted FSS participants and submit an FSS Action Plan to HUD on conversion

PHAs and Project Owners must follow the FSS regulations at 24 CFR part 984. Public housing residents who are FSS participants must be allowed to continue participating once their housing converts through RAD, for the duration of the grant's period of performance, and the Project Owner must ensure those participants continue to be served. The owner may administer its own FSS programme or enter a Cooperative Agreement with the PHA, another PHA or another owner to provide service coordination under 24 CFR parts 984 and 877 and current and future HUD guidance. In every administration scenario the Project Owner must submit an FSS Action Plan to HUD for approval upon RAD conversion where there are converted participants. Under a Cooperative Agreement the Project Owner assumes the administrative duties such as calculating and crediting escrow and reporting. The owner may continue enrolling new participants but need not if it plans to phase the programme out. Where the PHA ceases to be a PHA on conversion, or converts all FSS-eligible units and no longer wishes to run a programme, the FSS grant may be transferred to the PBRA Project Owner for the remainder of the grant period of performance.
