RAD PBRA residents get notice of grounds, an informal hearing before an impartial staff member, and a written decision

As additional resident procedural rights complying with section 6 of the 1937 Act, and in addition to the notice requirements of 24 CFR part 245, HUD requires that residents be provided with notice of the specific grounds of the project owner's proposed adverse action and of their right to an informal hearing with the project owner; that residents have an opportunity for an informal hearing with an impartial member of the project owner's staff within a reasonable period; that residents may be represented by a person of their choice, question witnesses, have others make statements, and examine the regulations and evidence relied on; and that the project owner provide a written decision within a reasonable period stating the grounds and the evidence relied on. The project owner is bound by the decision except where the matter exceeded the hearing officer's authority or the decision is contrary to HUD requirements or law. These items must be included in the project's House Rules, which must be submitted to HUD for review before Closing.
